1. Agreement to Terms
By accessing or using Scenair ("the Service"), operated by Scenair ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all visitors, users, and subscribers of scenair.com.
2. Description of Service
Scenair is an AI search visibility platform that tracks how brands are mentioned across AI platforms including ChatGPT, Gemini, and Perplexity. The Service provides visibility scores, competitor analysis, citation source tracking, and actionable recommendations to improve AI search presence.
3. Accounts
When you create an account, you agree to:
- Provide accurate, current, and complete information
- Maintain the security of your password and account
- Accept responsibility for all activity under your account
- Notify us immediately of any unauthorized access
We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.
4. Free Scan
Scenair offers a free AI visibility scan that does not require account creation. By using the free scan, you agree that we may store the domain and email address you provide to deliver your results. The free scan is provided "as is" and may be subject to rate limiting or availability constraints.
5. Subscriptions and Payment
Plans and Pricing
Scenair offers three tiers (Starter, Pro, and Scale), each priced as a monthly base fee plus a per-subject add-on (each tracked client or product line). Current pricing is available on our website and inside the app at Settings → Billing. We reserve the right to modify pricing with 30 days' notice to existing subscribers.
Billing
- Subscriptions are billed monthly in advance via Stripe.
- All fees are in US Dollars and are non-refundable except as described in §6 below.
- Adding a subject mid-cycle adds a prorated charge to your next invoice. Removing a subject mid-cycle credits the prorated unused portion against your next invoice.
- You authorize us to charge your payment method on file for recurring subscription fees.
- Failed payments trigger a 7-day grace period during which you can update your card via the customer portal. After that, paid features are paused until payment clears.
Tier Changes
- Upgrades take effect immediately. Stripe prorates the difference between your current plan and the new plan for the remainder of the period and charges the difference today. Your billing cycle resets to the upgrade date.
- Downgrades are scheduled for your next billing date. You retain your current tier's features through the end of the period. No refund or proration credit is issued for the downgrade itself.
Cancellation
You may cancel your subscription at any time through your account settings or via the Stripe customer portal. Cancellation takes effect at the end of the current billing period. You retain access to paid features until that date. No refund is issued for the unused portion of the period after cancellation.
6. Refund Policy
Subscription fees are non-refundable. This includes the monthly base fee, per-subject add-ons, and any prorated upgrade charges. You can cancel at any time and keep access through the end of the period you've already paid for; no partial refund is issued for the unused portion.
Exceptions. We will issue a refund only when:
- You were charged in error (duplicate billing, charges after a successful cancellation).
- The Service was materially unavailable for an extended outage during a billing period, pro-rated to the affected days.
To request a refund under one of these exceptions, contact support@scenair.com within 30 days of the charge with your invoice ID. Refund decisions are at our reasonable discretion.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its related systems
- Interfere with or disrupt the Service or servers connected to it
- Scrape, crawl, or use automated tools to extract data from the platform beyond normal API usage
- Resell, sublicense, or redistribute the Service without our written consent
- Use the Service to harass, abuse, or harm others
- Submit false, misleading, or fraudulent information
- Exceed the usage limits of your subscription plan
8. Intellectual Property
The Service, including its design, code, features, content, logos, and documentation, is owned by Scenair and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written consent.
You retain ownership of any data you submit to the Service (domains, brand information, etc.). By using the Service, you grant us a limited license to use this data solely to provide the Service to you.
9. Data and Reports
Scenair generates visibility reports by querying third-party AI platforms. You acknowledge that:
- AI platform responses may vary over time and are not guaranteed to be consistent or accurate
- Visibility scores are relative measurements based on the prompts and platforms we query
- We do not guarantee specific results or outcomes from following our recommendations
- Report data reflects a point-in-time snapshot and AI responses may change between scans
10. AI-Generated Content
Scenair drafts long-form content pages (and other operator-facing artifacts) using third-party AI models. Drafts are clearly marked as AI-generated inside the app. You acknowledge and agree that:
- Human review is required. You are responsible for reviewing, editing, and fact-checking every AI-generated draft before publishing it on your or your client's website.
- Drafts may contain inaccuracies. AI models can produce statistics, citations, attributions, or claims that are wrong or fabricated. We surface a flag when we detect likely-hallucinated stats, but we cannot catch every error.
- You own and control what ships. Once you click "Ship," the published content is your content. Scenair is not a publisher, agent, or co-author and bears no liability for content published by you or on your behalf.
- Disclosure obligations are yours. You are responsible for complying with any laws, platform policies, or jurisdictional rules in the United States, the European Union, or elsewhere that require disclosing AI-assisted content to your end audience.
- Third-party model terms apply. Drafts are produced by OpenAI, Anthropic, Google, and Perplexity models. By using the Service you agree your usage complies with their respective acceptable-use policies for generated output.
11. Limitation of Liability
To the maximum extent permitted by law, Scenair and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total liability for any claims arising under these terms shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
13. Indemnification
You agree to indemnify and hold harmless Scenair and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these terms, or infringement of any third-party rights.
14. Modifications to Terms
We reserve the right to modify these terms at any time. We will notify users of material changes by posting the updated terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the modified terms.
15. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved in the courts of Delaware.
16. Severability
If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full effect.
